Judicial Review of Home Office Decisions

Challenging unlawful Home Office decisions

We act in judicial review proceedings against the Home Office, from the pre-action letter to the final hearing, for individuals and for businesses.

When judicial review is available

Judicial review is the means of challenging a public law decision that carries no right of appeal, or one that is unlawful, procedurally unfair or irrational. In immigration matters it is commonly used against refused administrative reviews, sponsor licence revocations, the certification of claims, and unreasonable delay in deciding applications. Where proceedings need to be issued, we can conduct the litigation on your behalf.

  • Pre-action protocol letters
  • Grounds and claim forms
  • Urgent applications and interim relief
  • Claims for unreasonable delay
  • Sponsor licence revocation challenges
  • Permission and substantive hearings

A claim must be brought promptly and in any event within three months of the decision, and shorter limits apply in some cases. Most immigration judicial reviews are heard in the Upper Tribunal. Early advice is essential.
