Deprivation of Citizenship

Defending your British citizenship

Deprivation of citizenship is among the most serious decisions the Home Office can take. We act for those under investigation and for those whose citizenship has been removed, from the first Home Office letter through to appeal.

When the Home Office can act

The Home Secretary may deprive a person of British citizenship where it is considered conducive to the public good, or where citizenship was obtained by fraud, false representation or the concealment of a material fact. Cases commonly arise from discrepancies in identity, nationality or immigration history given in earlier applications, sometimes many years before naturalisation. The consequences extend beyond the individual, and can affect the status of family members and the right to remain in the United Kingdom.

  • Responding to Home Office investigation letters
  • Representations against a proposed deprivation decision
  • Appeals to the First-tier Tribunal
  • Challenges to the subsequent immigration decision
  • Cases involving historic identity or nationality discrepancies
  • Advice on the position of spouses and children

Why early advice matters

The Home Office usually writes before deciding, inviting an explanation. That response is often the single most important document in the case, because it frames how the decision maker sees the history and what discretion may be exercised. Once a decision is made there is a right of appeal, but the time limits are short and the issues are complex. We advise on the response from the outset and represent you throughout any appeal.
